This End User License Agreement (“Agreement”) is between You and KINGSOFT Mobile Security Plus and governs use of this App made available through the App Store. By installing the KINGSOFT Mobile Security Plus App, You agree to be bound by this Agreement and understand that there is no tolerance for objectionable content. If You do not agree with the terms and conditions of this Agreement, You are not entitled to use the KINGSOFT Mobile Security Plus App.
Our Privacy Policy, located at https://www.kingsoft.jp/is/mobile/privacy-en , is part of and is governed by this Agreement. By accepting this Agreement, You agree to be bound by the terms of the Privacy Policy and agree that we may use information collected from You in accordance with its terms.
1. Parties
This Agreement is between You and KINGSOFT Mobile Security Plus and not with the Google Play Store (“Google”) or Apple App Store (“Apple”)（collectively referred to as ”Third Party App Store”. You agree to comply with, and your license to use the KINGSOFT Mobile Security Plus is conditioned upon, your compliance with the applicable Third Party App Store terms and conditions. To the extent that other terms and conditions of the Google Play Store are less restrictive than, or otherwise conflict with, this Agreement, the more restrictive term will apply.
2. Privacy
KINGSOFT Mobile Security Plus may collect and use information about your usage of the KINGSOFT Mobile Security Plus App, including certain types of information from and about your device. KINGSOFT Mobile Security Plus may use this information, as long as it is in a form that does not personally identify you, to measure the use and performance of the KINGSOFT Mobile Security Plus App.
3. Limited License
KINGSOFT Mobile Security Plus grants You a limited, non-exclusive, non-transferable, revocable license to use the KINGSOFT Mobile Security Plus App for your personal, non-commercial purposes. You may only use the KINGSOFT Mobile Security Plus App on devices that You own or control and as permitted by the Third Party App Store Terms of KINGSOFT Mobile Security Plus.
4. Ownership
4.1. No Ownership Rights. The App is licensed, not sold. KINGSOFT Mobile Security Plus retains all ownership rights in and to the App, including any intellectual property rights therein.
4.2. Copyright. The App contains material that is protected by Japan and foreign intellectual property laws, including copyright, trade secret, and patent law. All rights not granted to You herein are expressly reserved by KINGSOFT Mobile Security Plus. You may not remove any copyright or other proprietary notice of KINGSOFT Mobile Security Plus from the App.
4.3. Content. Content, including files, links, images, and text, made available or accessible through the App is the sole responsibility of the person or entity from whom it originated and is the property of the applicable owner. You accept all responsibility for security risks and any damage resulting from any content viewed or accessed through the App, and KINGSOFT Mobile Security Plus is not responsible for any damage or loss caused by your use or reliance on any content, goods or services, or information available through third party sources regardless of how presented.
You should not infringe any intellectual property rights. You are solely responsible in using this App to copy, forwarding or spread any content from the internet. You should obtain any necessary permission before such operations. You are solely responsible for any legal liability arose by your abuse of this App and any contents.
4.4. Submissions. Any communications sent to KINGSOFT Mobile Security Plus are the property of KINGSOFT Mobile Security Plus or its affiliates. Unless stated otherwise herein, submissions are not considered confidential, and KINGSOFT Mobile Security Plus is not liable for any use or disclosure of a submission. Except as noted herein, KINGSOFT Mobile Security Plus is entitled to unrestricted use of any submissions for any purpose whatsoever without compensation to the provider of the submission.
5. Warranty
KINGSOFT Mobile Security Plus disclaims all warranties about the KINGSOFT Mobile Security Plus App to the fullest extent permitted by law. To the extent any warranty exists under law that cannot be disclaimed, KINGSOFT Mobile Security Plus, not Apple or Google, shall be solely responsible for such warranty.
6. Affirmative Representations
・When You use the KINGSOFT Mobile Security Plus, You represent that:
・your use of KINGSOFT Mobile Security Plus does not violate any applicable law or regulation;
・You are of sufficient legal age or otherwise have legal capacity to legally enter into this Agreement.
7. Prerequisites and Activation
In order to use the KINGSOFT Mobile Security Plus, You must first agree to be bound by the terms of this Agreement and our Privacy Policy.
In order to be able to activate the App, You may need to agree to allow the App to have access to the following information and features located on the user’s device:
・Device and Application History
・Identity
・Photos and media files
・Camera; microphone
・Wi-Fi Connections
・Device ID and Call Information.
・Location Information
8. Maintenance and Support
KINGSOFT Mobile Security Plus does provide minimal maintenance or support for it but not to the extent that any maintenance or support is required by applicable law, KINGSOFT Mobile Security Plus, not Apple or Google, shall be obligated to furnish any such maintenance or support.
9. Product Claims
KINGSOFT Mobile Security Plus, not Apple or Google, is responsible for addressing any claims by You relating to the KINGSOFT Mobile Security Plus App or use of it, including, but not limited to: (i) any product liability claim; (ii) any claim that the KINGSOFT Mobile Security Plus App fails to conform to any applicable legal or regulatory requirement; and (iii) any claim arising under consumer protection or similar legislation. Nothing in this Agreement shall be deemed an admission that You may have such claims.
10. Third Party Intellectual Property Claims
KINGSOFT Mobile Security Plus shall not be obligated to indemnify or defend You with respect to any third party claim arising out or relating to the KINGSOFT Mobile Security Plus App. To the extent KINGSOFT Mobile Security Plus is required to provide indemnification by applicable law, KINGSOFT Mobile Security Plus, not Apple or Google, shall be solely responsible for the investigation, defense, settlement and discharge of any claim that the KINGSOFT Mobile Security Plus App or your use of it infringes any third party intellectual property rights.
11. Prohibited Activities
You agree that, in connection with your use of the KINGSOFT Mobile Security Plus App, You will not:
・decompile, disassemble, modify, translate, adapt, reverse engineer, create derivative works from or sublicense the KINGSOFT Mobile Security Plus App, or any portion thereof; or
・circumvent, disable or otherwise interfere with security related features of the KINGSOFT Mobile Security Plus App or features that prevent or restrict use or copying of any part of the App.
